Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TickLearn website, web application and related services (together, the “Service”), operated by Albakio (“TickLearn”, “we”, “us” or “our”). By creating an account or using the Service — including signing in with Google or Facebook — you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your personal information.

The Service is an educational platform used by schools, principals, teachers and students. You must provide accurate information when creating an account and keep it up to date.

Many of our users are students who may be minors. Student accounts are typically created and supervised by a school, principal or teacher, or by a parent or guardian, who is responsible for that account and for providing any required consent. If you are using the Service on behalf of a school or organisation, you represent that you are authorised to do so.

• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
• You must notify us promptly of any unauthorised use of your account or any other breach of security.
• You may not share your account, impersonate another person, or use someone else’s account without permission.

• Some features require a paid subscription. The applicable plan, price, duration and any student/seat limits are shown at the time of purchase.
• Payments may be reviewed and approved by our team before access is unlocked. Access is granted for the duration of the active plan and ends when the plan expires.
• Unless required by law or expressly stated otherwise, payments are non-refundable. We may change plans and pricing for future purchases; changes do not affect a plan you have already paid for during its active term.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Copy, download, record, redistribute, resell or publicly share course content, videos, questions or other materials except as expressly permitted.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems; probe, scan or test for vulnerabilities; or interfere with normal operation.
• Upload or transmit malware, or content that is illegal, harmful, abusive, infringing or otherwise objectionable.
• Use automated means to access or scrape the Service without our permission.

The Service and its content — including courses, videos, questions, text, graphics, logos and software — are owned by TickLearn / Albakio or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, educational, non-commercial purposes. All rights not expressly granted are reserved.

You may provide information and content such as your profile details, photo, and quiz responses. You retain ownership of your content and grant us a licence to host, store and use it as needed to operate and provide the Service. You are responsible for ensuring you have the right to share any content you provide.

You may sign in using Google or Facebook. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services, and their availability is outside our control.

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may add, modify, suspend or discontinue features at any time, and may perform maintenance that temporarily limits access.

We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or misuse the Service. You may stop using the Service at any time and may request deletion of your account as described in our Privacy Policy. Provisions that by their nature should survive termination (including ownership, disclaimers and limitations of liability) will continue to apply.

The Service and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will meet your requirements or that educational outcomes will be achieved.

To the maximum extent permitted by law, TickLearn and Albakio will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or profits, arising from your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

You agree to indemnify and hold harmless TickLearn and Albakio from any claims, damages and expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. The courts located in Pakistan will have jurisdiction over any disputes, subject to any mandatory rights you may have under local law.

We may update these Terms from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, notify you through the Service. Continued use of the Service after an update means you accept the revised Terms.
